Liability, Waiver, and Indemnity Agreement for Children's Classes, Holiday Programs, Events, and Performances
This Agreement (hereinafter referred to as the "Agreement") is entered into between the parent(s)/guardian(s) (hereinafter referred to as the "Parent(s)/Guardian(s)") and The Centre of Dance PTY LTD (hereinafter referred to as the "Centre").

1. Acknowledgement of Risk

1.1. Participation in children’s classes, holiday programs, events, and performances conducted by the Centre involves physical activities and carries inherent risks, including, but not limited to, muscle strain, falls, and other potential injuries.
1.2. By enrolling their child, the Parent(s)/Guardian(s) confirm that their child is in good health, physically capable of participating, and is aware of and accepts these risks.
​2. Release of Liability

2.1. In consideration for permitting the child's participation in the activities, the Parent(s)/Guardian(s) hereby fully and irrevocably release, waive, discharge, and covenant not to sue the Centre, its owners, employees, instructors, agents, and contractors from any and all claims, liabilities, injuries, or damages arising out of or in any way related to the child's participation, whether such claims are based on negligence or otherwise, except in cases of gross negligence or willful misconduct by the Centre.
2.2. This release is intended to be as broad and inclusive as permitted by the laws of Queensland, Australia.

3. Indemnity
​
3.1. The Parent(s)/Guardian(s) agree to indemnify and hold harmless the Centre, its owners, employees, instructors, agents, and contractors from any and all claims, demands, or actions, including legal costs, arising out of the child's participation in the activities, including, but not limited to, any injuries, damages, or losses sustained.
3.2. This indemnity also covers any third-party claims related to the child's participation.

4. Supervision
​
4.1. The Centre is responsible for supervising children only during scheduled class, rehearsal, or performance times.
4.2. The Centre shall not be responsible for the care or supervision of the child before or after these scheduled times unless prior arrangements have been made.
4.3. The Parent(s)/Guardian(s) are responsible for ensuring timely drop-off and pick-up of the child.

5. Transport and Offsite Activities
​
5.1. The Centre does not arrange or provide transportation for children to and from classes, events, or performances.
5.2. The Parent(s)/Guardian(s) are solely responsible for the safe transportation of the child to and from the Centre and any offsite activities.
5.3. The Centre shall not be liable for any incidents or accidents arising from transportation arranged by the Parent(s)/Guardian(s).

6. Emergency Medical Treatment

6.1. In the event of a medical emergency, the Parent(s)/Guardian(s) authorise the Centre and its staff to administer first aid and/or seek immediate medical treatment for the child.
6.2. All costs associated with emergency medical treatment shall be the sole responsibility of the Parent(s)/Guardian(s).

7. Special Medical Conditions
​
7.1. The Parent(s)/Guardian(s) must disclose any medical conditions, allergies, or special needs that may affect the child's participation in the activities.
7.2. The Centre shall not be responsible for managing or administering medication unless a separate written agreement has been made prior to the child's participation.

8. Media Release
​
8.1. By enrolling their child, the Parent(s)/Guardian(s) grant permission to the Centre to use photographs, video recordings, and other media capturing the child's participation in classes, events, and performances for promotional purposes.
8.2. This includes, but is not limited to, use on social media, advertising materials, and the Centre’s website.
8.3. If the Parent(s)/Guardian(s) do not wish for their child's image to be used, they must notify the Centre in writing prior to the child's participation.

9. Governing Law
9.1. This Agreement shall be governed by and construed in accordance with the laws of Queensland, Australia.
9.2. Any disputes arising from or related to this Agreement shall be resolved in the appropriate courts of Queensland.

10. Confirmation of Participation
During registration, the Parent(s)/Guardian(s) must check the designated box, thereby confirming that they have read, understood, and agree to the terms and conditions of this Agreement on behalf of their child.
